General Conditions - Toys"R"Us

Toys are an important enjoyable part of our lives, so we want to keep it simple and clear by displaying our terms and conditions here. They have been written to be fair, clear and provide you with guidance of each part of your interaction together with Toys"R"US. They also help to let you know what to expect when placing orders with us and about our pricing and other policies

In these Terms and Conditions "we" and "us" mean Toys R Us Licensee Pty Ltd ABN 57 632 418 494 of 45-49 McNaughton Road Clayton VIC 3168 Australia, and "you" means you the customer. These Terms and Conditions together with your Order constitute the entire Contract between us and you for the supply of Products. The Contract cannot be varied unless we agree to vary it in writing or by email.

Placing an Order with Toys"R"US

You may place an Order by filling in the Order Form on the Toys"R"US Web Site and clicking the "Confirm Order" button. When you place your Order, we will issue you with an Order Number via email. By placing an Order, you make an offer to us to purchase the Products you have selected based on these Terms and Conditions. We will notify you that your order is being processed by sending you an Order Confirmation and tax invoice via email; however, we do not formally accept your offer until your order has passed our internal validation procedures for verifying the bona fides of each order placed, for the purpose of preventing credit card or payment fraud. Toys"R"US and its affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion. We will confirm acceptance of your order when we send you an email confirming shipment of the goods you have ordered. If we cannot process or accept your Order after payment is received we will refund your order for the amount that is paid. Please note that we cannot accept responsibility for third party fees or exchange rate differences in the event of order cancellation and refunds.

Payment Methods and Acceptance

Toys"R"US currently accepts PayPal, Visa, MasterCard and Direct Deposit only. Payment processing will not begin until we receive all the information we need. Orders placed on a weekend or a Public holiday will not begin payment processing until the next business day. Business days are Monday through Friday, excluding state and federal public holidays. If a Direct Deposit payment is not received within 7 days from the date that you receive your Order Confirmation, Toys"R"US reserves the right to cancel the transaction.

Please Note:

  • We are unlikely to accept credit cards issued by banks outside of Australia.
  • Debit cards and cheque cards have daily spending limits that may delay the processing of your order.
  • You may be required to provide further identification for additional security reference checks.

 

GST and Currency

Toys"R"US product prices displayed are in Australian dollars (AUD) and include GST for Australian customers. If we display prices in other currencies, we will clearly state the currency and symbol alongside the amount.

For shipments to international destinations, GST is not incurred and the price displayed is the final price that you are charged and sometimes includes an offset to reduce international freight. Where we display currencies other than AUD, the currency will be clearly labelled alongside the price.

Prices

Toys"R"US always seeks to list Products with the most competitive prices. Toys"R"US reserves the right to change prices for Products displayed at Toys"R"US at any time before you place an Order. The price of products shown excludes shipping costs. Shipping costs are shown separately on the product page but may be recalculated based on how many and what items you place in your shopping cart.

Warranty and Returns

Refunds

Toys"R"US do not normally provide refunds or exchanges if you:

  • Simply change your mind; or
  • Purchased the wrong product; or
  • Damage a product after purchase due to alterations to the product not performed by us, damage the product due to unusual or non-recommended use of the product or damage the product where the damage is caused by any factors beyond our control; or
  • No proof of purchase is provided.

Option of refund, replacement, credit or repair are available to you in the event of a confirmed fault, have been wrongly described, are different to the product purchased on the website or don't perform as advertised. We cannot guarantee that a replacement or repair will be available if the product is either discontinued or no longer available. We will speak with you about your options if that affect you, whereby either a refund, credit or alternative (similar) product may be available for you to select from.

Force Majeure

To the extent permitted by law, Toys"R"US is not liable for any delay in performing any of its obligations under these Terms and Conditions if such delay is caused by circumstances beyond the reasonable control of Toys"R"US, and Toys"R"US shall be entitled to a reasonable extension of time for the performance of such obligations.

Governing Law

By placing an order with Toys"R"US you agree that the sale is made in the state of Victoria, Australia. These Terms and Conditions shall be governed by and construed in accordance with the laws of Victoria and shall be subject to the non-exclusive jurisdiction of the courts of Victoria.
